This AUP applies to the following:
- Websites developed and hosted by Make Me Modern Inc.
- Websites developed elsewhere and later migrated to our servers.
- Content or activity by third-party marketers, developers, or contractors with access to your hosted account.

Use of our servers must comply with all applicable laws. You may not transmit, distribute, or store content that:
- Violates local, state, federal, or international law.
- Contains or links to child sexual abuse material (CSAM).
- Infringes upon intellectual property rights.
- Facilitates or supports unlawful activity.
2. Hacking and Unauthorized Access
You may not host, promote, or distribute hacking tools, or attempt unauthorized access to any network or system.
3. Service Disruption
You may not interfere with the integrity or performance of our services or those of others. This includes denial-of-service (DoS) attacks, resource abuse, or malicious scripts.
4. Proxy Use
Use of proxy software (including anonymizing proxies) is strictly prohibited due to security and abuse concerns.
5. Spam and Unsolicited Email
You may not use our infrastructure to send unsolicited bulk email, operate spam-related services, or relay email without authorization. Violations will result in immediate termination without refund. Refer to our Anti-Spam Policy for additional details.
6. Harvesting Personal Information
Scraping, phishing, or collecting personal information (e.g., emails, usernames) without user consent is not allowed.
7. IP Blacklisting
If any IP assigned to your account is listed in public abuse databases (e.g., Spamhaus), we may suspend or terminate your service to protect network reputation—regardless of direct intent.
8. Impersonation & Spoofing
You may not impersonate individuals or businesses, or forge email headers or network identities.
9. SEO Abuse
We prohibit Black Hat SEO tactics, including scraper sites, keyword stuffing, and search engine manipulation that harm performance or violate ethical standards.
10. High-Risk Content
You may not host content likely to provoke targeted cyberattacks (e.g., DDoS), including inflammatory or controversial material beyond the tolerance of a shared infrastructure.
11. Hosting Misuse
Hosting is intended for running websites and related email. General data storage (e.g., media archives, personal backups, mail vaults) is not permitted. We may charge additional fees or discontinue such usage.
12. Adult Content
Adult content networks such as banner exchanges, free TGPs, or image galleries are not allowed.

IRC bots, bouncers, and similar automation software are not permitted.
15. BitTorrent
BitTorrent and peer-to-peer file sharing are not allowed due to their high risk for abuse—even when used for legitimate purposes.

Processes that open external network sockets are not allowed. Localhost-bound services may be permitted if they do not affect server stability or other accounts.
Third-Party Developers, Tools, and Marketers
You may use reasonable third-party tools—including SEO plugins, analytics, and development frameworks—provided they:
- Do not introduce security or performance issues.
- Comply with all terms of this policy.
- Operate within the limits of your hosting plan.
We reserve the right to disable or restrict plugins, processes, or scripts that compromise server performance or security.
Customer Responsibility
You are responsible for all activity on your hosted account, including actions by employees, agencies, contractors, or third parties. Unintentional or third-party violations of this AUP are still considered your responsibility.
Indemnification
You agree to indemnify, defend, and hold harmless Make Me Modern Inc., its employees, officers, and affiliates from any claims, losses, damages, or legal expenses arising from your (or your agents’) breach of this AUP.

Anti-Spam Policy
Last Updated: May 9, 2025
Make Me Modern Inc. ("we," "us," or "our") is committed to promoting responsible and compliant communication practices online. This Anti-Spam Policy outlines the standards that apply to all customers using our services to send email or other bulk messages. Violations of this policy may result in immediate account suspension or termination without refund.
This policy applies to all communication sent via email, newsletters, contact forms, web tools, SMS, or other digital messaging systems, whether using our systems directly or through external software or vendors. Customers are responsible for ensuring compliance, regardless of whether communication is sent through our infrastructure or a third-party platform.
1. Prohibition Against Spam
"Spam" refers to any form of unsolicited or unauthorized message sent in bulk, including but not limited to:
- Unsolicited email.
- Mass messaging via instant messaging, social media, or SMS.
- Off-topic promotions in online forums, blogs, guestbooks, or comment systems.
Spam is strictly prohibited and constitutes a violation of our Terms of Service. Any account found to be using spam in connection with our services will be disabled immediately, without notice or refund.
2. Mailing List Requirements
Opt-In Confirmation
All mailing list recipients must have explicitly opted in to receive messages. This includes:
- A single confirmation email sent to the user's address.
- A link to your privacy policy.
- A description of the list's content.
- A unique confirmation URL the user must click to complete enrollment.
Subscriber Records
Customers must maintain the following for each subscriber:
- Date and time of confirmation.
- IP address at time of confirmation.
- Form or webpage where the sign-up occurred.
These records must be produced upon request by Make Me Modern Inc.
Transparency
You must clearly disclose how email addresses will be used and whether they will be shared with third parties. This disclosure must appear:
- On the signup page, or
- Via a clear link to your privacy policy.
Purchased or Third-Party Lists
Use of purchased or third-party email lists is strongly discouraged and permitted only under the strictest conditions outlined below. In most cases, their use will lead to degraded deliverability and increased compliance risk. If used, the following conditions must be fully met:
- The list source has a public privacy policy that explicitly permits list resale or sharing.
- The signup page used by the subscriber linked to that privacy policy at the time of opt-in.
- The privacy policy has remained materially unchanged since the time of signup.
- You retain records of the signup time, IP address, and source URL.
- Subscribers are re-confirmed via a direct opt-in confirmation email before being contacted.
Failure to meet any of these conditions may result in account suspension.
3. Mailing Practices
- You must not falsify or obscure message headers or sender information.
- Email addresses that result in more than 5 hard bounces must be removed from future sends.
- Unsubscribe instructions must be clear, functional, and honored within 10 business days.
- All mass communications must provide recipients with a simple and visible way to opt out.
Customers are responsible for the actions of any affiliate marketers, agencies, or third-party email vendors they engage. These parties are held to the same standards as if they were your employees.
4. Spamware
The sale, promotion, or use of software specifically designed to facilitate spam ("spamware") is strictly prohibited in conjunction with any Make Me Modern account. This includes tools that harvest emails, automate bulk sending, or disguise sender identity.
5. Enforcement and Disablement
Make Me Modern Inc. reserves the right to suspend or permanently disable any account found to be engaged in spamming or any behavior reasonably believed to be in violation of this policy.
Customers must respond in full to any spam-related inquiries from Make Me Modern Inc. within 72 hours. Failure to respond may result in account disablement.
To report suspected spam originating from a Make Me Modern customer, please visit /legal/#reporting-abuse.
6. Liability and Indemnification
Customers are solely responsible for all email or message activity conducted through their account. You agree to indemnify, defend, and hold harmless Make Me Modern Inc., its employees, officers, and affiliates from any liability, claims, damages, or legal costs arising from a violation of this policy, including actions taken by affiliates, vendors, or contractors on your behalf.
7. Policy Updates
Make Me Modern Inc. may revise this Anti-Spam Policy at any time. Material changes will be communicated via email or account notifications. Continued use of our services constitutes acceptance of any updated terms.

1. No Resale or Monetization of Client Data
We do not sell, rent, license, or otherwise monetize your data, designs, code, contact lists, or project information — ever.
2. Reasonable and Scoped Access Only
We do not access your website, hosting environment, admin panels, or source files without cause. However, access may be necessary when:
- Delivering hosting, maintenance, or update services.
- Reviewing implementation, code performance, or security configurations.
- Investigating technical issues or errors.
- Performing backup, quality assurance, or optimization tasks.
Access is limited to relevant personnel and is logged and monitored internally. We do not explore or copy client content for internal projects, testing, or training unless expressly permitted.
3. You Own Your Content
All original content, designs, source code, and assets you provide or pay us to create remain yours. We retain no rights to reuse your work unless you've explicitly granted permission (e.g., portfolio showcases).
4. Internal Access is Strictly Controlled
Only authorized Make Me Modern personnel are granted access to your hosting environment or administrative tools. Access is logged, time-limited, and restricted by role.
5. Backups and Data Handling
We handle your data with the same care we handle our own. For hosting clients, backups are encrypted, geographically redundant, and accessible only to designated engineers.
6. Responsible Use of Monitoring Tools
We may install traffic monitoring tools, such as our proprietary libraries (e.g., m3Pixel, m3Doyle, or analytics plugins), to evaluate site performance, track usage trends, or ensure quality assurance. These tools do not collect personally identifiable information unless explicitly configured to do so.
We do not use client traffic or behavioral data for advertising, remarketing, or sale to third parties.
7. Respect for Legal Boundaries
We comply with privacy regulations such as GDPR and CCPA. When required by law (e.g., subpoena, court order), we may disclose limited information — but only after verifying the request's legality and necessity.
8. Questions or Concerns?
Transparency is part of the pledge. If you have any questions about how we handle your data, reach out anytime at legal@makememodern.com.
9. Our Proprietary Technologies
As part of delivering services, we may install and maintain proprietary software or code developed by Make Me Modern — including but not limited to:

- m3Doyle (used for quality assurance and error monitoring)
- m3Guesty (used for Guesty integration)
- m3NGINX (used for NGINX configuration and optimizations)

These tools are owned by Make Me Modern and licensed to you solely for use on your site during the term of our engagement. They may not be modified, copied, extracted, or reused outside of your hosted site without our written permission. Upon termination of services, we may remove or disable these components.

Migration Terms of Service
Last Updated: May 9, 2025
These Migration Terms of Service ("Terms") govern all WordPress migration services provided by Make Me Modern Inc. ("Make Me Modern," "we," "us," or "our"). By requesting a migration, you ("Customer," "you," or "your") agree to be bound by these Terms, our General Terms of Service, and our Acceptable Use Policy.
1. Scope of Service
Our standard WordPress migration includes:
- Transfer of WordPress files, themes, plugins, and media.
- Database and content export/import.
- Post-transfer review to confirm basic functionality and display.
This service does not include:
- DNS changes or propagation.
- Email account or server migration.
- Custom scripts or non-WordPress applications.
- SSL certificate installation (unless explicitly included).
Requests beyond this scope may require a separate quote or agreement.
2. Turnaround Time
We target completion within 48 hours from when we send an email confirming the official start of migration. This commitment assumes:
- You provide valid, complete credentials in response to our "Request for Credentials" (RFC).
- We confirm access to the source WordPress site.
If you fail to respond to communications for more than 12 hours, the 48-hour window no longer applies. We will continue the migration in good faith but cannot guarantee timeline adherence.
3. Customer Responsibilities
You agree to:
- Provide all requested access credentials promptly.
- Remove unnecessary backups, media, or large files before migration.
- Ensure your WordPress installation is clean, updated, and malware-free.
- Maintain your source site in a live, unchanged state until migration completion is confirmed.
Sites running WordPress versions older than 3.7 must be upgraded prior to migration. We reserve the right to decline or pause migrations for compromised or unstable environments.
4. Data Integrity and Limitations
We aim for accuracy but cannot guarantee a pixel-perfect or bug-free result. Minor issues may arise due to differences in themes, plugins, or server environments.
You acknowledge that:
- You are responsible for post-migration testing and validation.
- You are solely responsible for backing up your data before and after migration.
- We do not retain long-term backups of your migrated site unless otherwise agreed in writing.
5. Email Exclusion
Email migration, including inboxes, settings, and domain mail configurations, is excluded. You are responsible for managing any email platform transition separately.
6. Refund Eligibility
The migration fee is refundable only if:
- We fail to complete the migration within the 48-hour window due to internal delays.
- You cancel the migration before we send the confirmation email indicating the start of the process.
No refund will be issued if:
- You fail to respond to communications for 12+ hours after the process starts.
- You attempt to intervene or override the migration process.
- You cancel after the migration has begun.
- We discover malware or instability that prevents completion.
7. Abandonment
If we do not receive a response within 7 days of any migration-related request, the project will be marked as abandoned and canceled. We may retain files for up to 30 days, at our discretion, to support potential reinstatement.
8. Cancellation
You may cancel the migration at any time by written notice. However, cancellation after the process has started forfeits refund eligibility. Site integrity may not be preserved if cancellation occurs mid-transfer.
9. Limitation of Liability
To the fullest extent permitted by law, Make Me Modern disclaims all warranties, express or implied, and is not liable for indirect, incidental, or consequential damages related to migration. Our total liability is limited to the amount you paid for the migration service.
10. Changes to Terms
We may revise these Terms at any time. Updates will be posted on this page and take effect upon publication. Continued use of our migration services after updates constitutes acceptance of the revised terms.

Professional Services Terms
Last Updated: May 9, 2025
These Professional Services Terms (“Terms”) apply to all non-hosting services provided by Make Me Modern Inc. (“Make Me Modern,” “we,” “us,” or “our”), including but not limited to website design, development, branding, SEO, consulting, and other project-based work (“Services”). By requesting or purchasing any Professional Services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms in addition to our General Terms of Service.
1. Scope of Services
Professional Services may be recurring (e.g., SEO retainers) or non-recurring (e.g., website design). The specific scope, deliverables, timeline, and pricing will be set forth in:
- A written proposal or quote, or
- A confirmed statement of work (SOW), kickoff confirmation, or similar written agreement.
Unless explicitly stated otherwise, all deliverables include one (1) round of revision. Additional revisions, changes, or work beyond scope may be billed separately at our then-current hourly or project rates.
2. Renewals and Promotional Terms
Recurring Services will automatically renew for the same term at the same rate unless canceled with at least 7 calendar days’ notice prior to renewal.
Bundled or promotional services will renew at the then-current retail rate unless canceled with 30 calendar days’ notice before the renewal date. Cancellation requests must be submitted to billing@makememodern.com.
3. Customer Responsibilities
To ensure timely and successful delivery, you agree to:
- Provide all required content, assets, and access credentials in a timely manner.
- Respond to communication or review requests within 3 business days.
- Clearly communicate goals, preferences, and actionable feedback.
- Promptly review and approve milestones or deliverables.
If you fail to respond within the stated timeframe, we may treat the deliverable as approved and continue work accordingly.
4. Intellectual Property and Promotional Use
4.1. Ownership of Deliverables
All final deliverables become your exclusive property upon full payment of all fees due. Until payment is received in full, all intellectual property rights remain with Make Me Modern. We may withhold delivery or disable access to any work until payment is complete.
4.2. Portfolio Rights
We reserve the right to showcase completed work (e.g., screenshots, excerpts, or descriptions) in our portfolio and promotional materials unless you request confidentiality in writing before project launch.
5. Cancellations and Refunds
5.1. Cancellations
If the primary service in a bundle is canceled, associated services will also be canceled. Prorated refunds may be issued at our sole discretion for unused portions of the services that have not yet been performed.
5.2. Refund Policy
We do not issue refunds for work already completed or time already spent. Deposits and upfront fees are non-refundable. In the event of cancellation, we may — at our discretion — offer a partial refund for unperformed work based on actual time, costs, and resources allocated.
6. Disclaimers and No Guarantees
We do not guarantee specific business outcomes or performance results from our Services, including SEO, design, or marketing work. Success depends on a variety of external factors beyond our control.
All Professional Services are provided “as is.” We disclaim all warranties, express or implied, and limit our liability as described in our General Terms of Service.
7. Delays and Force Majeure
We are not liable for delays caused by:
- Failure by you to provide content, access, or feedback.
- Third-party platform outages or vendor issues.
- Events outside our control (e.g., acts of God, government restrictions, infrastructure failures).
If your inaction causes a project to stall for more than 30 days, we reserve the right to consider the project complete and invoice for remaining work.
8. Non-Solicitation
You agree not to directly solicit, hire, or contract with any employee, freelancer, or subcontractor engaged by Make Me Modern during your project or within 12 months after its completion without our written permission.
9. Modifications
We may update these Terms from time to time. Changes will be posted on our legal page and will take effect upon publication. Continued use of our Services constitutes acceptance of the revised terms.

- Real-time monitoring for uptime and performance issues.
4. Monitoring and Response
Our team is alerted in real time to unusual activity or service interruptions. We investigate potential incidents and apply patches or mitigations promptly.
5. Third-Party Providers
We vet all subprocessors and infrastructure providers for strong security reputations and compliance with standard security frameworks. You can review our current subprocessor list at [Insert Link].

- Not installing unverified plugins or making unauthorized code changes.
- Reporting suspicious activity to us at support@makememodern.com.
7. Disclaimers
We follow industry best practices to secure our environments, but no system can be guaranteed 100% secure. Clients are encouraged to maintain their own offsite backups, enable 2FA on their platforms, and follow responsible user access hygiene.

SSL Certificate Terms
Last Updated: May 13, 2025
Make Me Modern Inc. ("Make Me Modern," "we," "us," or "our") requires that all hosted websites maintain an active and valid SSL/TLS certificate at all times. This policy ensures the security and integrity of our hosting infrastructure and protects end users from unencrypted content delivery.
1. Certificate Provider
All SSL certificates are issued via Let's Encrypt, a free and automated certificate authority managed by the Internet Security Research Group (ISRG). By using our services, you agree to be bound by the terms of the Let's Encrypt Subscriber Agreement.
2. SSL Service Fee
We charge an annual fee for SSL provisioning, configuration, monitoring, and automated renewal. This fee covers the cost of managing the SSL lifecycle and enforcing secure HTTPS connections on all hosted sites. Pricing may be updated periodically.
3. Renewals and Limitations
SSL certificates are set to renew automatically. However, successful renewal depends on domain availability, proper DNS configuration, and uninterrupted connectivity. If your domain expires or DNS records are misconfigured — and these services are not managed by Make Me Modern — we are not responsible for failed renewals, expired certificates, or resulting outages.
4. Mandatory HTTPS and Redirects
All websites hosted on our platform must use HTTPS. We enforce automatic redirection from HTTP to HTTPS and will not support unsecured content delivery. Attempting to disable SSL or remove secure configurations is a violation of our hosting terms.
5. Required Compliance
SSL is a mandatory requirement for all websites on our hosting network. Refusal to use or maintain SSL may result in immediate suspension or termination of your hosting services, without refund. This policy exists to protect the integrity of our infrastructure, your users, and your business reputation.
6. Third-Party Certificates
We do not currently support third-party SSL certificate installations. If you require a certificate issued by another authority, you must migrate hosting to a provider that accommodates such configurations.
